These Terms and Conditions ("Terms") govern your use of the NaturePins mobile application and website (together, the "Service"), operated by NaturePins (ABN 57 347 823 466) ("we", "us", "our").

By creating an account or using NaturePins, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About NaturePins

NaturePins is an outdoor discovery platform that allows users to discover, save, and record visits ("pin") to natural locations across Australia. The Service includes location discovery, visit tracking, challenges and achievements, social features, and related functionality.

2. Eligibility

You must be at least 16 years old to create a NaturePins account. By creating an account, you represent that you are at least 16 years of age. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Service.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current information when creating your account and to update it if it changes.

You must not share your account with others, create multiple accounts, or create an account on behalf of someone else without their permission.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Using NaturePins

You agree to use NaturePins in a lawful and respectful manner. Specifically, you agree not to:

Misuse the platform: Post false, misleading, or spam content. Pin locations you have not visited. Create fake reviews or manipulate ratings.

Harass or harm others: Post content that is abusive, threatening, discriminatory, defamatory, or that invades another person's privacy. Stalk, harass, or intimidate other users.

Post harmful content: Upload content that is illegal, obscene, sexually explicit, promotes violence, or contains hate speech.

Interfere with the Service: Attempt to gain unauthorised access to the Service or its systems. Use bots, scrapers, or automated tools to access or collect data from NaturePins without our written permission. Reverse-engineer, decompile, or disassemble any part of the Service.

Infringe intellectual property: Upload content that infringes the copyright, trademark, or other intellectual property rights of any third party.

Endanger safety: Share content that could endanger others at natural locations (for example, promoting dangerous access routes, illegal camping, or activity in restricted areas).

We may remove content and suspend or terminate accounts that violate these Terms at our discretion.

5. Content You Create

5.1 Your ownership

You retain ownership of all content you create and upload to NaturePins, including photos, reviews, notes, and lists ("User Content").

5.2 Licence you grant us

By posting User Content on NaturePins, you grant us a non-exclusive, royalty-free, worldwide, transferable licence to use, display, reproduce, and distribute that content within the Service and on NaturePins web pages. This includes displaying your photos on location pages, showing your reviews to other users, rendering your pins on share cards, and featuring your content in promotional materials for NaturePins (such as app store screenshots or social media posts showcasing the app).

This licence continues for as long as your content remains on the Service. If you delete your content or your account, the licence ends, except where your content has already been shared by other users or incorporated into aggregated data (such as average ratings).

5.3 Public and private content

Public content: Your display name, profile photo, public reviews, ratings, pin locations (without private notes), and challenge achievements are visible to other NaturePins users and may appear on publicly accessible NaturePins web pages (such as location pages indexed by search engines).

Private content: Your private notes are visible only to you. Your saved places and lists are private by default unless you explicitly share them.

5.4 Content guidelines

Reviews should be honest, based on personal experience, and helpful to other users. We reserve the right to remove reviews that are fraudulent, contain spam or advertising, are unrelated to the location, or violate these Terms. We do not edit the substance of genuine reviews.

6. Intellectual Property

The NaturePins name, logo, brand assets, app design, and all original content created by us (including location descriptions, icons, map designs, and achievement badges) are the intellectual property of NaturePins and are protected by Australian and international intellectual property laws.

You may not use the NaturePins name, logo, or brand assets without our prior written permission, except as enabled by the share card functionality within the app.

7. Location Data and Safety

7.1 Accuracy

Location information on NaturePins is sourced from public datasets, government sources, user contributions, and other third-party sources. While we make reasonable efforts to ensure accuracy, we do not guarantee that location data (including coordinates, descriptions, access information, track conditions, or difficulty ratings) is accurate, complete, or current.

7.2 Your responsibility

You are solely responsible for your own safety when visiting any location found through NaturePins. This includes checking current conditions, weather, tides, fire warnings, park closures, and any relevant safety information from official sources (such as state national parks services) before visiting.

NaturePins is not a substitute for official park information, emergency services, or navigation tools. Always carry appropriate equipment, let someone know your plans, and exercise caution in natural environments.

7.3 No liability for conditions

We are not liable for any injury, loss, damage, or death that occurs while visiting any location listed on NaturePins. Natural environments carry inherent risks including but not limited to falls, drowning, wildlife encounters, extreme weather, bushfire, and remoteness. You assume these risks when choosing to visit any location.

8. Subscriptions and Payments

8.1 Free and Pro tiers

NaturePins offers a free tier and a paid Pro subscription. The features available in each tier are described in the app and on our website. We reserve the right to change what is included in each tier with reasonable notice.

8.2 Billing

Pro subscriptions are billed monthly or annually through the Apple App Store or Google Play Store. By subscribing, you agree to the billing terms of the relevant app store. Prices are displayed in your local currency and include applicable taxes.

8.3 Cancellation

You may cancel your Pro subscription at any time through your app store account settings. Cancellation takes effect at the end of your current billing period. You will retain Pro features until that date. We do not provide partial refunds for unused portions of a billing period.

8.4 Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their refund policies. If you believe you have been charged in error, contact us at support@naturepins.app and we will assist you.

8.5 Price changes

We may change subscription prices with at least 30 days' notice. Price changes will take effect at the start of your next billing period after the notice period. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

9. Challenges, Achievements, and Physical Rewards

9.1 Challenges and achievements

NaturePins offers challenges and achievements as part of the app experience. We reserve the right to modify, add, or remove challenges and achievement criteria at any time. Achievement badges are digital features of the Service and have no monetary value.

9.2 Physical rewards

From time to time, we may offer physical rewards (such as enamel pins) for completing challenges or promotions. Physical reward promotions are subject to their own specific terms, which will be communicated at the time of the promotion. Physical rewards are subject to availability, limited to one per qualifying user (unless otherwise stated), and are shipped to Australian addresses only (unless otherwise stated). We reserve the right to verify that qualifying criteria were genuinely met before dispatching a reward.

9.3 Sponsored challenges

Some challenges may be sponsored by third-party partners (such as tourism boards or regional councils). Sponsored challenges are clearly labelled. Participation in sponsored challenges may involve your anonymised, aggregated participation data being shared with the sponsoring partner. Your personal information is not shared with sponsors without your explicit consent.

10. Third-Party Services and Links

NaturePins may contain links to third-party websites, apps, or services (such as mapping providers, accommodation booking sites, or tourism board websites). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and subject to their own terms.

11. AI-Powered Features

NaturePins uses artificial intelligence to power certain features, including smart review prompts, personalised recommendations, and location descriptions. AI-generated content is provided for convenience and may not always be accurate. You should verify any factual information (such as track distances, facilities, or conditions) against official sources.

AI features process your data in accordance with our Privacy Policy. Your content is not used to train AI models.

12. Availability and Changes

We aim to keep NaturePins available and functional, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice in the app at least 14 days before the changes take effect. Your continued use of NaturePins after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.

13. Disclaimers

To the maximum extent permitted by Australian law:

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that location data, descriptions, reviews, or any content on NaturePins is accurate, reliable, complete, or current.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

14. Limitation of Liability

To the maximum extent permitted by Australian law, NaturePins and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to loss of data, loss of revenue, personal injury, or property damage.

Our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the amount you have paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.

These limitations do not apply to liability that cannot be excluded or limited under Australian law, including liability under the Australian Consumer Law.

15. Indemnity

You agree to indemnify and hold harmless NaturePins, its officers, employees, and contractors from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms, your User Content, or your use of the Service in violation of any law or third-party rights.

16. Termination

You may terminate your account at any time by deleting it through the app's settings. We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. We will handle your data in accordance with our Privacy Policy, including deleting your personal data within 30 days of account deletion.

17. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising out of or relating to these Terms or the Service will be resolved in the courts of New South Wales, Australia.

Before commencing legal proceedings, you agree to first contact us at support@naturepins.app to attempt to resolve the dispute informally. We will make reasonable efforts to resolve any dispute within 30 days.

18. General

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and NaturePins regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
